Asset Division as Taught by the Brangelina Split

The Pitts – 41-year-old actress and humanitarian Angelina Jolie Pitt and 52-year-old actor and producer Brad Pitt – have an estimated net worth of $400 million. Jolie has an estimated net worth of $140 million and Pitt has an estimated net worth of $240 million, according to CNBC.

Division of their massive assets can prove complex. Jolie filed for divorce last Monday, September 19 in Los Angeles Superior Court in California from Pitt, citing irreconcilable differences and asking for full custody of their six children. Jolie is not asking for spousal support in her divorce filing.

Couples who take residence in several states can choose which residence they want to claim as their primary residence and which state they want to file for divorce. According to the American Academy of Matrimonial Lawyers President Joslin Davis,  picking one state over the other can make a big difference when it comes to gaining favorable ground in matters such as asset division.

When your ex wants to move your kids out of state

One of the major concerns of any divorced parent is that his or her ex-spouse will decide to move out of state and take the children with them. This obviously threatens your relationship with your children, as you won’t be able to get to them as quickly as your once were. In this situation, your best option will be to seek our a family law attorney to help you take steps to prevent your children from being moved away from you.

Before a divorced parent can do anything that may violate a court-ordered parenting plan, he or she must prepare and submit a written notice to the other parent as well as the court. This notice must be delivered at least 60 days prior to enacting the violation, meaning you should get this notice at least two months before your ex moves away. The notice should include the following information:

  • Address and phone number of the new residence
  • Reason for the move
  • Proposed parenting schedule

Usually, a judge will make determinations in these situations based on which parent has primary custody. If custody is split, a judge will look at other factors before ruling.

At Alexander & Associates, we make it our priority to fight for what is best for you and your family. We want you to know that we can represent you in a variety of cases, and we will devote our experience and skill to protecting your interests. Call us today at (972) 420-6560 to discuss your case.

NPO encourages passage of equal parenting bill in Texas

With Father’s Day celebration just ended, National Parents Organization board member and Texas resident Robert Franklin encouraged state residents to ask their congressmen or congresswomen to vote for the equal parenting bill that will be presented in the state legislature in the coming legislative session, the Victoria Advocate reported on June 20.

Many other courts have taken this route, which would discourage the tendency to award a mother sole custody of their children. The NPO cites studies that say that children do best when both parents remain involved in his or her life.

Divorce Tips for an Amicable Split

Huffington Post writer John McElhenney outlined his experiences with divorce and how to maintain an amicable relationship with your ex-spouse through it all, especially if you have kids.

First, the welfare of the children should be considered the most important. The money always comes second. In Texas, 85 percent of divorce cases end up with the mom getting physical custody of the children and the father receiving non-custodial status, which usually means he must pay child support and the child’s health insurance. Although you may not agree on exactly how to divide shared assets and debts, remember that the children are more important than the money, and it’s important not to become contentious over small matters.

Last of all, McElhenney stresses that it is the attitude of the parents that will determine how the divorce goes and how the children will react to it.
