Being Charged with Marijuana Possession

Perhaps the most frequently used drug today is marijuana. Several states have adopted full legalization of marijuana while almost half of the states have legalized it for medicinal purposes. Marijuana is still currently designated a Schedule I drug, however, and carries with it unreasonably harsh punishments if caught for possession in states where it is not yet legal. Due to its common use among young adults, people constantly have to waste precious resources to deal with these unfair punishments, especially in the conservative state of Texas.

Types of Marijuana Charges

Fortunately, marijuana charges are allotted special conditions that alleviate some of its stricter punishments; different quantities of possession hold varying levels of offense. However, any amount of marijuana can possibly lead to jail time and below is a breakdown of the type of charge subject to quantity of possession:

  • 2oz or less – Class B Misdemeanor, penalties up to 180 days in jail and fines of $2000
  • 2oz to 5lbs – Class A Misdemeanor, penalties up to 1 year in jail and fines of $4000
  • 5lbs and over – State Felony, penalties 2-10 years in state prison and fines of $10000

It is common for possession charges under 2oz to be dismissed after a drug treatment program and a probation period. The majority of marijuana users are non-violent offenders and the notion of jail time for a simple possession charge is unnecessary.
